1. Agreement and who we are
These Terms of Service ("Terms") are a binding agreement between you and Isaacs Cloud LLC ("Folktales," "we," "us," or "our"), the operator of the Folktales service at folktales.io and related apps (the "Service").
By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Folktales.

2. Eligibility
You must be at least 13 years old to use Folktales. If you are under 18, you may use the Service only with the consent of a parent or legal guardian who agrees to these Terms on your behalf.
You are responsible for ensuring your use complies with laws that apply to you.
3. Using Folktales
Folktales is a community for writers to share drafts, get feedback, find beta readers, and talk about craft. We may change, suspend, or discontinue features during early beta without liability to you beyond what the law requires.
You agree to provide accurate account information, keep your login secure, and not share your account. You are responsible for activity under your account.
4. Your writing stays yours
You keep ownership of the content you post ("User Content"), including drafts, chapters, poems, forum posts, feedback, and profile text.
By posting User Content, you grant Folktales a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, perform, and distribute that content solely as needed to operate, secure, and improve the Service (for example, showing a draft to another member you shared it with).
You represent that you have the rights needed to post your User Content and to grant this license. Do not post work you do not have the right to share.
5. Copyright, plagiarism, and intellectual property
Respect other people's intellectual property.
You agree not to copy, scrape, republish, sell, distribute, train machine-learning models on, or otherwise use another member's writing or User Content without their clear permission. That includes drafts, chapters, poems, forum posts, feedback notes, and private bios.
Plagiarism, unauthorized copying, and copyright infringement are grounds for immediate suspension or ban, removal of content, and, where appropriate, reporting to rights holders or law enforcement.
If you believe content on Folktales infringes your copyright, see the DMCA section below. You can also report suspected plagiarism or theft in-product (Report → Plagiarism / IP theft) or email help@folktales.io.
6. DMCA copyright notices
Isaacs Cloud LLC respects copyright law, including the Digital Millennium Copyright Act (17 U.S.C. § 512).
To submit a copyright infringement notice, email ike@isaacs.cloud (or help@folktales.io with subject "DMCA") and include:
1. Your physical or electronic signature.
2. Identification of the copyrighted work claimed to be infringed.
3. Identification of the material that is claimed to be infringing, and information reasonably sufficient to locate it on Folktales (URL or work title and author username help).
4. Your name, mailing address, telephone number, and email address.
5. A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

We may remove or disable access to allegedly infringing material and, in appropriate circumstances, terminate accounts of repeat infringers.
If your material was removed and you believe that was a mistake, you may send a counter-notification meeting the requirements of 17 U.S.C. § 512(g) to the same contacts.
7. Spoilers and drafts
Writers often share unfinished or unpublished work here. By using Folktales, you agree to treat drafts with care.
If you spoil someone's plot, twists, or unpublished material outside the intended feedback context, or you do it to harass or ruin the work for others, we may ban you.
Folktales is not liable for spoilers, leaks, screenshots, or anything a member chooses to share beyond the intended audience. We will still take reports seriously and may remove content or ban accounts when someone abuses trust.
8. Community conduct
Be usable to other writers. Prohibited conduct includes, without limitation: hate speech; harassment; threats; spam; sexual content involving minors; unmarked NSFW where warnings are expected; scraping or automated abuse; attempting to bypass bans; and any illegal activity.
We may hide content, lock threads, remove material, or suspend or ban accounts at our discretion for Terms violations or behavior that makes the community unsafe or unusable.
9. Feedback, matching, and no professional advice
Feedback and Match suggestions are community tools, not professional, legal, editorial, or publishing advice. Other members' opinions are theirs. Folktales does not guarantee anyone will read your work, respond kindly, keep your secrets, or offer you publication opportunities.
10. Accounts, bans, and termination
We may suspend or permanently ban accounts that violate these Terms. You may delete your account from Settings, subject to retention described in the Privacy Policy.
If your account is banned or deleted, you lose access to the Service. We may retain records needed for safety, abuse prevention, fraud prevention, and legal compliance.
11. Service availability and disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" DURING EARLY BETA. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We are not liable for downtime; lost drafts beyond ordinary care; third-party outages (including hosting, email, and auth providers); decisions made by other members; or unauthorized access despite reasonable safeguards.
Some jurisdictions do not allow certain disclaimers. In those places, our disclaimers apply to the fullest extent allowed.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Isaacs Cloud LLC AND ITS OFFICERS, MEMBERS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).
These limits apply even if a remedy fails of its essential purpose. They do not limit liability that cannot be limited under applicable law (for example, certain liability for willful misconduct where prohibition is not allowed).
13. Indemnity
You agree to defend, indemnify, and hold harmless Isaacs Cloud LLC and its officers, members, and agents from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your User Content, your use of the Service, or your violation of these Terms or applicable law.
14. Governing law and disputes
These Terms are governed by the laws of the State of Iowa, without regard to conflict-of-law rules, except that the Federal Arbitration Act may apply to arbitration agreements if we later add one by updated Terms you accept.
Except where prohibited, you agree that courts for disputes will be the state or federal courts located in Scott County, Iowa, and you consent to personal jurisdiction there.
If you are a consumer, you may also have mandatory rights under the law of your place of residence that these Terms cannot waive.
15. Changes to these Terms
When we update these Terms, we will bump the version and ask you to accept the new Terms before continuing to use Folktales. Continued use after acceptance means you agree to the updated Terms.
